Thabaletsi Tombstones Terms and Conditions of Sale (Cash Sale and Lay-bye)

Effective Date: 1 March 2025

Notice: These terms govern all sales by Thabaletsi Tombstones. By signing, you acknowledge understanding and accepting them fully. Review carefully and consult our staff for clarification before proceeding.

Dear Valued Customer,

Purchasing a tombstone is an investment to honour your loved ones. These terms ensure a smooth transaction and protect our business.

General Terms

1. Documentation and Responsibility

• You must review all documents thoroughly and provide accurate, complete information (e.g. names, dates, installation details). A proof will be provided for your written approval before manufacturing.
• Thabaletsi Tombstones is not liable for errors, costs, delays, or misunderstandings if you fail to seek clarification or approve incorrect details. No refunds, compensation or replacements apply in such cases.

2. Ownership and Amendments

• The tombstone remains our property until fully paid. No design or specification changes are allowed post-approval unless we agree, at your additional cost.
• This signed document is the sole binding agreement; verbal or external terms are unenforceable unless mutually signed.

Installation Terms

3. Installation Responsibilities and Delays

• You must provide functional contact details, be available on the installation date, and meet our team at the site. Failure to do so incurs rescheduling and travel costs at your expense, with no refunds or liability on our part.
• Installation dates are estimates and may move due to unforeseen events (e.g., weather, defects). We are not liable for delays or losses and no compensation applies.

4. Customer-Arranged Transport/Installation

• If you transport or install the tombstone, ownership transfers upon collection. We are not responsible for subsequent damage, loss, or issues and no returns or refunds apply.

Payment Terms

5. Lay-bye, Pricing and Refunds

• ● Lay-bye deposits are flexible, but manufacturing begins only at 100% payment. Prices include VAT; legal VAT increases will adjust your balance. Cash and lay-bye prices are equal.
• Payments are non-refundable upon cancellation. After 12 months, inflation-based price increases apply annually, and cancellation forfeits all payments per CPA Section 17. In exceptional circumstances, at our sole discretion, a refund may be granted, subject to a 5% handling fee.

6. Transportation Costs

• Installation within 100 km of our branches is included; beyond that, you pay the prevailing AA rate per kilometer in advance.

Additional Conditions

7. Storage, Branding, Permits and Graveyard Access

• Unclaimed tombstones incur monthly storage fees post-manufacture. After 6 months, we may dispose of or recycle them without refund or liability.
• We may affix our name and contact details to the tombstone.
• You are responsible for obtaining and submitting installation permits at your cost and arranging keys for graveyards requiring locked access. If we arrive at the scheduled installation time and cannot work due to the absence of a key or permit, we will rebook at our discretion, and you will be charged an additional fee for the return visit, including travel costs per Clause 6. We are not liable for related delays or penalties, and no refunds or compensation apply.

8. Natural Materials and Liability Exclusions

• Granite/marble variations are natural and not grounds for refund or replacement.
• We are not liable for damage or issues from acts of nature (e.g., lightning, flooding), site instability, vandalism, misuse (e.g., chemicals causing engraving fade), statutory changes, third-party products, or causes beyond our control, unless overridden by Clause 11’s guarantee.

Order and Manufacturing Terms

9. Timeline and Verification

• Allow 21 working days from proof approval and/or slab installation for completion, subject to operational constraints. Retain payment receipts and email bank transfer proofs to admin@thabaletsi.co.za; delays from missing proof are your responsibility.

Installation and Maintenance

10. Slab and Risks

• A slab is recommended for stability. We are not liable for damage from inadequate or customer-built slabs, or if you opt for no slab (Clause 8 applies).
• The customer also confirms that they have been given the sizes of the slab that is required and if they are building a slab that they must build according to the sizes given to them.

11. Limited One-Year Guarantee

• We offer a one-year guarantee from installation, covering only defects we directly cause, at our discretion. Claims require written evidence (e.g., photos) within one year; we may repair, replace, or deny them. Clause 8 exclusions (e.g., nature, misuse) prevail beyond one year or if applicable.

Customer Acknowledgment

Important: Signing confirms your understanding and acceptance of all terms, including liability exclusions and non-refundable conditions. Failure to read or clarify, does not make this agreement null and void.

Customer Declaration

I, the undersigned, confirm that I have read, understood, and agree to these Terms and Conditions. I accept full responsibility for this order, confirm that all information provided is accurate and complete, and acknowledge that production will proceed based on the approved proof.
